Last updated 21 May 2026. The terms below comply with the South African Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002.

1. Who we are

This website (aquacart.co.za) is operated by AquaCart, a Johannesburg-based premium water retailer ("AquaCart", "we", "us", "our"). These terms govern your access to, and purchase from, this website.

By placing an order, using the site, or otherwise transacting with us, you confirm you have read, understood, and accept these terms.

2. Ordering and acceptance

Your placement of an order is an offer to buy. Our acceptance happens when we confirm the order via email or WhatsApp. We may decline any order at our sole discretion (for example: out of stock, payment failure, suspected fraud, or a delivery address outside our service area) and will refund any payment taken if we do.

All orders are subject to stock availability. If we cannot fulfil part of your order, we will contact you to agree a substitution, partial order, or refund.

3. Pricing and payment

All prices are quoted in South African Rand (ZAR), inclusive of Value Added Tax (VAT) where applicable. Prices may change at any time but the price displayed at checkout is the price you pay for that order.

Payment is processed by Ozow (instant EFT). We do not store your full bank or card details — payment information is handled directly by Ozow under their PCI-compliant infrastructure.

4. Delivery

We deliver only within Johannesburg, South Africa. Delivery fees, areas, and timing are set out on our delivery page.

Title to the goods and risk of loss or damage passes to you on delivery to the address you provide. You must ensure the delivery address is accurate and that someone is available to accept delivery. We are not liable for goods left at an unattended address at your instruction.

5. Damaged or incorrect items

If goods arrive damaged or we deliver an incorrect item, notify us within 24 hours of delivery by WhatsApp or email with a photograph. We will arrange a replacement on the next delivery run or refund the affected items, in line with our refunds policy.

6. Cooling-off period (CPA s44)

In terms of section 44 of the Electronic Communications and Transactions Act, you may cancel an online order without reason and without penalty within seven (7) days after the date you received the goods. Cancellation must be made in writing (email or WhatsApp).

The goods must be returned to us in their original, sealed, undamaged condition. We will refund the full purchase price within 30 days of cancellation, less the direct cost of returning the goods (R75 collection fee unless we delivered the wrong item).

The cooling-off period does not apply to goods that, by their nature, cannot be returned or are perishable (per ECT Act s42(2)).

7. Curator's Box subscriptions

Subscriptions to The Curator's Box renew automatically each month. You may pause or cancel at any time, without penalty, by contacting us at least 48 hours before your next scheduled delivery date. Pre-paid months that have already been dispatched cannot be refunded.

8. Age and consumption

Our products are bottled water. We do not sell alcohol. There is no minimum age restriction beyond the legal capacity to enter into a contract under South African law (18 years).

9. Consumer rights (CPA)

Nothing in these terms limits your rights as a consumer under the South African Consumer Protection Act 68 of 2008 (CPA), including the right to safe goods of good quality, fit for purpose, free of defects, and durable for a reasonable period of use.

10. Limitation of liability

To the maximum extent permitted by law, our liability to you in respect of any claim arising from these terms or your purchase is limited to the price you paid for the goods that gave rise to the claim. We are not liable for indirect or consequential losses (loss of profit, loss of opportunity, loss of business goodwill).

Nothing in this clause limits liability for: (a) fraud or fraudulent misrepresentation; (b) death or personal injury caused by our negligence; or (c) any liability that cannot be excluded under South African law.

11. Privacy

We process your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and our privacy policy.

12. Intellectual property

All content on this site — including text, images, logos, brand names, and design — is owned by AquaCart or used under licence from the respective brand owners. You may not reproduce, redistribute, or use any content for commercial purposes without our written consent.

13. Electronic acceptance

You accept these terms electronically when you place an order, create an account, or otherwise indicate your acceptance. Per the ECT Act, an electronic communication or signature has the same legal effect as a written, signed acceptance.

14. Dispute resolution

If you have a complaint, please contact us first — we aim to resolve any issue within five business days. If we cannot resolve the matter informally, you may refer the dispute to the South African Consumer Goods and Services Ombud or to the National Consumer Commission.

15. Governing law and jurisdiction

These terms are governed by the laws of the Republic of South Africa. Any dispute arising from these terms is subject to the non-exclusive jurisdiction of the South African courts.

16. Changes to these terms

We may amend these terms from time to time. Material changes will be flagged on this page and the "last updated" date will be revised. Continued use of the site after a change constitutes acceptance of the updated terms.
